Fowler v Family Dollar

Fowler, et al. v. Family Dollar. This case was filed on behalf of Store Managers who received a salary but were required to work 70 or 80 hours a week without additional pay. Family Dollar claims the Store Managers are exempt from overtime but we believe the Store Manager’s primary function was not managerial, but rather performing the routine job required to operate the store.

This case was transferred to the U.S. District Court for the Western District of North Carolina in Charlotte and consolidated with other cases that have been filed against Family Dollar throughout the country involving Store Managers. Presiding Judge Graham C. Mullen has refused to conditionally certify the class and his decision is currently being appealed to the Court of Appeals.
